  Latest Court Ruling on a Disability Discrimination Case  
 
A judgment was delivered in the District Court on 7 March 2008, which ruled in favour of an employee, Mr. Ip whose contract of employment was terminated because of his disability. When Mr. Ip was working for a restaurant in 2005, he was subjected to unlawful discrimination on the ground of disability after he had injured his wrist and taken nine days of sick leave. The employer was ordered to pay HK$94,545 in compensation to Mr. Ip .
 
 
 
The court described Mr. Ip as “discharging his duties faithfully” and that he was given an above average staff performance appraisal.
 
 
 
Under the Disability Discrimination Ordinance, it is wrongful for employers to dismiss employees on the ground of their disabilities. Employers should be mindful that employees who are sick or injured are entitled to protection under the Disability Discrimination Ordinance.
