EOC Welcomes the Government’s Enactment of Legislation in accordance with Article 23 of the Basic Law

The Equal Opportunities Commission (EOC) welcomes the Hong Kong SAR Government’s decision to initiate public consultation and legislative work on Article 23 of the Basic Law. This would further improve the legal system, safeguard national security, and ensure the continuous and stable development of Hong Kong.

Mr Ricky CHU Man-kin, EOC Chairperson, said: “The Hong Kong SAR Government has a constitutional duty to legislate for Article 23 of the Basic Law. In addition to strengthening the rule of law, the legislation would foster stability in society, enhance the protection of the rights and freedom of members of the public, as well as their lives and properties. This would enable different groups in society to enjoy equal opportunities to develop and improve their livelihoods.”

Mr Chu added: “The EOC supports the Government’s proposed definition of seditious intention, which includes the intention to induce hatred or enmity amongst residents of the HKSAR or amongst residents of different regions of China. As previous incidents in society have shown, instigating discord and inducing enmity between residents of the HKSAR and the Mainland not only damage relations between the residents, but also disrupts social order and creates societal divide. As the statutory body tasked with the implementation of the anti-discrimination legislation, the EOC is committed to eliminating discrimination and fostering an inclusive and harmonious society through law enforcement, prevention, and education. The EOC hopes the SAR Government can complete the enactment of legislation under Article 23 soon to safeguard national security, and ensure the long-term stability and prosperity of Hong Kong.”
