EOC launches MTR ad campaign to raise awareness against harassment in common workplaces

The EOC recently launched an MTR advertising campaign to raise awareness of the protections against sexual harassment, disability harassment and racial harassment in common workplaces under the Sex Discrimination Ordinance, Disability Discrimination Ordinance and Race Discrimination Ordinance respectively. Posters presenting example scenarios have been placed across 60 MTR stations until 8 September 2022.

Following recommendations by the EOC to the Government, Hong Kong’s anti-discrimination laws were amended in 2020 to introduce protections against sexual harassment, disability harassment and racial harassment between “workplace participants” sharing a common workplace. These include not only employees, but also contract workers, interns and volunteers.

Even if the harasser and the victim work for different companies or organisations, the harasser can be liable provided they work in the same workplace as the victim, and the harassment takes place in that workplace. Think co-working spaces, expos and trade shows, or department stores stationed with salespersons of different brands.

Organisations, too, may be held vicariously liable for the harassment if it is committed by their employees, interns or volunteers in the course of employment or the relevant internship or voluntary work.
