EOC Gives Legal Assistance in Sex Discrimination Case

10/05/2001

The Equal Opportunities Commission (EOC) has today (10 May 2001) issued legal proceedings under the Sex Discrimination Ordinance (Cap 480) in the District Court on behalf of a woman who was told to resign before she reached her retirement age. But the company has retained a male employee, who continued to work after he was formally retired at the same time as the plaintiff.

The EOC has granted legal assistance in this case on the basis that the case raises a significant question of sex discrimination in the field of employment, where older women rather than older men are more readily dismissed from employment or made redundant. This issue is of widespread concern in Hong Kong and employers need to be made aware that this type of conduct is unlawful.
