EOC Gives Legal Assistance in Disability Discrimination Case
The Equal Opportunities Commission (EOC) has today (16 December 2011) issued legal proceedings under the Disability Discrimination Ordinance, Cap. 487 in the District Court, on behalf of a complainant whose employment was terminated by her former employer, allegedly on the ground of her having to take sick leave for medical examinations and treatments due to her illness. The Plaintiff was diagnosed to have liver metastatic neuroendocrine tumor and had received medical treatments for about several months. Her employment service was allegedly terminated under the pretext of poor business.

The EOC Calls for Prompt Action by the EDB to Provide Equal Educational Opportunities for Ethnic Minority Children at the Meeting of the Legislative Council Panel on Education
The Equal Opportunities Commission (EOC) called today (12 December 2011) for prompt and concrete action to address the issue of education for ethnic minority (EM) children at the Meeting of the Legislative Council Panel on Education. At the Meeting, the EOC reiterated its deep concerns about existing barriers to quality education faced by many ethnic minority children, which limit their personal, social, and career development over the long-term.

Accessibility Case Settled Out Of Court
After commencing legal proceedings under the Disability Discrimination Ordinance (DDO) in July 2011 on behalf of a Plaintiff who is an elderly person with mobility difficulties residing at Pok Hong Estate in Shatin, the Equal Opportunities Commission (EOC) has successfully negotiated an out of court settlement on her behalf. As part of the settlement, the defendant who is the Incorporated Owners of the Estate has agreed to provide lift access to the second floor of the Lower Block and the Higher Block of Pok On House and Pok Man House.

EOC’s Response to Judiciary’s Review on Adjudication of Equal Opportunities Claims
The Equal Opportunities Commission (EOC) welcomes the Judiciary’s affirmation that anti-discrimination statutes are social legislation protecting civil rights and that equal opportunities (EO) claims should be adjudicated in a speedy and inexpensive manner, as suggested in a review paper released by the Judiciary today (1 September 2011).

Expiry of the Grace Period for Small Employers under the Race Discrimination Ordinance
The grace period for small employers under the Race Discrimination Ordinance (RDO) will expire tomorrow (17 July 2011). This exemption, in effect for the first three years after the enactment of the RDO in July 2008, was applicable to employers with no more than a total of five employees. Small employers, like all other employers, must observe the employment-related provisions of the RDO.

The EOC Gives Legal Assistance in Disability Discrimination Case – Access to Premises
The Equal Opportunities Commission (EOC) issued today (8 July 2011) legal proceedings under the Disability Discrimination Ordinance, Cap. 487, on behalf of a complainant, an elderly person who suffers from right knee osteoarthritis, resulting in acute pain when she walks up or down stairs. The Plaintiff has great difficulty accessing or leaving her home on a lower floor of a housing estate, as lift opening is blocked on the floor in the existing setup where her residence is. Despite repeated requests by the Plaintiff, no change was made by the Owners Corporation to provide her with lift access, forcing her to take the stairs.

Launching of Equal Opportunities TV Docu-drama Series
The Equal Opportunities Commission (EOC) announced a Year 2011 educational initiative today (31 March 2011) by launching a new TV docu-drama series on discriminatory cases, entitled “A Mission for Equal Opportunities” (非常平等任務). Produced by Radio Television Hong Kong (RTHK), the 6 episodes will be broadcast on TVB Jade Channel every Wednesday from 7:00 p.m. to 7:30 p.m. beginning 6 April, 2011.

EOC Supports LegCo’s Motion on Social Welfare Land Use Planning
In support of the Legislative Council’s motion, passed on 16 February 2011, on “Social Welfare Land Use Planning”, the Equal Opportunities Commission (EOC) urges the Government to include social welfare use as an important consideration of land use planning, and expedite the provision of lands for welfare use by disadvantaged groups, including persons with disabilities and persons with mental illness.

EOC’s Response to the District Court Ruling on Claim of Disability Vilification of People with Mental Illness
The Equal Opportunities Commission (EOC) noted that the District Court had ruled against the plaintiff who alleged that an article published by a newspaper on 9 September 2006 vilified persons with mental illness. The EOC will study the judgment and decide on the way forward.
